Weapons Charges Filed Against Two City Men

Two Jamestown men face local charges relating to the theft of AR-style rifles from a sporting goods store in Pine Grove Township in Warren County.

As The Post-Journal reported on Thursday, Damion E. Dalton, 20, of Jamestown was charged Sunday by the State Police at Corry with burglary, a class 2 felony; five counts of retail theft, a class 3 felony, criminal trespass – breaking into a structure, a class 2 felony; and criminal mischief – damaging property, a class 3 felony. It’s alleged the break-in took place Saturday at 11:29 p.m. at Tall Tales Sporting Goods on Market Street, Pine Grove.

Jamestown police announced their own charge on Thursday. The stolen guns were found in Jamestown after members of the Jamestown Metro Drug Task Force and Southern Tier Regional Drug Task Force executed a search warrant at 216 Forest Ave., Apartment 1, in Jamestown, with officers finding Dalton and Tyler T. Dalton, 25, inside the apartment.

After the residence was secured, detectives searched the property and located a stolen and defaced AR15 rifle as well as a second stolen, defaced, and disassembled carbine rifle, both with high-capacity magazines. At that time, Damion Dalton and Tyler Dalton were arrested and taken to the Jamestown City Jail.

In addition to the charges filed by the State Police at Warren and a previous warrant for criminal mischief, Damion Dalton faces one count of third-degree criminal possession of a weapon (possession of an assault weapon), two counts of third-degree criminal possession of a weapon (high capacity magazines), two counts of third-degree criminal possession of a weapon (defaced), and one count of fourth-degree criminal possession of stolen property.

Tyler Dalton, a convicted felon, is charged with one one count of third-degree criminal possession of a weapon (possession of an assault weapon), two counts of third-degree criminal possession of a weapon (high capacity magazines), two counts of third-degree criminal possession of a weapon(defaced), one count of fourth-degree criminal possession of stolen property and one count of seventh-degree criminal possession of a controlled substance for having a quantity of methamphetamine on his person.

It’s alleged the guns were stolen Saturday at 11:29 p.m. from Tall Tales Sporting Goods on Market Street, Pine Grove. According to the affidavit of probable cause filed by the State Police at Warren, two men entered the property, approaching the north side of the building to damage or alter electrical wires to the building. Then, at 11:43 p.m., they allegedly broke the front window of the store and stole five AR rifles. The men then ran north.

The State Police at Corry’s crime scene unit and State Police forensic service unit responded to the scene. Surveillance footage showed two white men committing the burglary, with one of the men not wearing a mask and the other’s nose showing through his mask. The surveillance footage was distributed over social media, and the State Police at Warren received an anonymous tip Sunday afternoon saying Dalton was involved in the burglary.

“An officer within Jamestown (Police Department) recognized and identified one of the individuals from the surveillance footage,” the affidavit of probable cause states. “The individual with no mask on was identified as Edward Dalton. Additionally, Jamestown PD related they had information to believe Dalton was in possession of the stolen firearms and was trying to sell them.”

The Jamestown Police Department was assisted by the Chautauqua County Sheriff’s Office, Dunkirk Police Department, Pennsylvania State Police, Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), Chautauqua County Tac Meds, and the Jamestown Fire Department.
