Former Inmate Sues County Over Jail Shower Fall
A Bemus Point man and former Chautauqua County Jail inmate has filed a claim against Chautauqua County for injuries he sustained in the jail’s shower.
Gary Hannold filed the lawsuit Friday in state Supreme Court in Mayville, saying he slipped and fell while taking a shower in the jail in Pod A on May 25 around 10 a.m. Hannold and his attorney say the fall was caused by negligence on the part of jail employees.
“The claimant was caused to violently slip and fall while taking a shower in Pod A located on the aforementioned premises due to the negligence, intentional acts, carelessness and recklessness in the maintenance, control, ownership and supervision by the employees, agents and/or servants of the respondents Chautauqua County Sheiff’s Department and County of Chautauqua in failing to provide slip-resistant flooring and/or matting. In addition, no safety measures were taken, as no alerts and/or signs posted warning and/or alerting the claimant as to the unreasonably dangerous slippery flooring in the area where the claimant was caused to slip and fall.”
The Bemus Point man says he suffered a concussion, headaches with tingling and numbness from the neck down both arms and other injuries. Hannold’s lawsuit, filed by attorney Joshua Sandberg of Cellino Law LLP, states Hannold is likely to incur more medical expenses, including potential surgery, drugs or other devices.
“Mr. Hannold will be making a claim for future medical expenses, future pain and suffering, impairment and permanent injuries,” states a notice of claim filed in July.
Responses haven’t yet been filed by the county.
