Pa. Charges Filed In December Gun Thefts

Pennsylvania charges have been filed against a Jamestown man who allegedly stole AR-style rifles from a sporting goods store in Pine Grove Township in Warren County in December.
Tyler T. Dalton, 25, was officially charged Thursday with burglary, a class 2 felony; five counts of retail theft, a class 3 felony, criminal trespass, a class 2 felony; criminal mischief, a class 3 felony; and five counts of theft by unlawful taking, a class 2 felony. He was taken to the Warren County Jail on $100,000 bail.
Dalton, who Jamestown police said in a December news release is a convicted felon, also faces charges in New York state of third-degree criminal possession of a weapon (possession of an assault weapon), two counts of third-degree criminal possession of a weapon (high capacity magazines), two counts of third-degree criminal possession of a weapon(defaced), one count of fourth-degree criminal possession of stolen property and one count of seventh-degree criminal possession of a controlled substance for having a quantity of methamphetamine on his person.
According to the affidavit of probable cause, two men entered the Tall Tales Sporting Goods store in Pine Grove Township on Dec. 14, approaching the north side of the building to damage or alter electrical wires to the building. Then, at 11:43 p.m., they allegedly broke the front window of the store and stole five AR rifles. The men then ran north. The State Police at Corry’s crime scene unit and State Police forensic service unit responded to the scene. Surveillance footage showed two white men committing the burglary, with one of the men not wearing a mask and the other’s nose showing through his mask. The surveillance footage was distributed over social media, and the State Police at Warren received a tip from Jamestown police saying Damion Dalton was involved in the burglary. Both Damion Dalton and Tyler Dalton were found in a Forest Avenue apartment with two of the stolen rifles recovered by police as well as store tags from the gun store.
A newer affidavit of probable cause filed Thursday states that in addition to stealing five rifles, Tyler Dalton and Damion Dalton allegedly broke multiple gun cases with a metal wrench, causing $8,957 in damage. One of the items found near the store was a single Levi’s sneaker. A single Levi’s sneaker matching the description of the shoe found at the scene of the burglary was found in the Forest Avenue apartment in Jamestown, according to the affidavit filed Thursday.
Damion E. Dalton, 20, of Jamestown had already been charged by the State Police at Corry with burglary, a class 2 felony; five counts of retail theft, a class 3 felony, criminal trespass – breaking into a structure, a class 2 felony; and criminal mischief – damaging property, a class 3 felony. In New York state he faces one count of third-degree criminal possession of a weapon (possession of an assault weapon), two counts of third-degree criminal possession of a weapon (high capacity magazines), two counts of third-degree criminal possession of a weapon (defaced), and one count of fourth-degree criminal possession of stolen property.
