KIANTONE-A Kiantone man who allegedly fired a replica cannon at his neighbors in November rejected a plea deal offered by the Chautauqua County District Attorney's Office on Tuesday.
Brian J. Malta, 52, who faces three counts of menacing and three counts of harassment after an alleged property dispute led him to fire a Civil War cannon-loaded only with powder and wadding-several times at his neighbors' house, is still reportedly considering the offer since no time limit was given to make a decision, according to his attorney Parker MacKay.
MacKay said that he will file a motion requesting that Malta's firearms-which he said were confiscated by the Chautauqua County Sheriff's Office-be returned to someone else for safekeeping.
"The cannon is really the only thing that is questioned in this case," MacKay said.
Malta is scheduled to appear in Kiantone Court again on Jan. 14.
