Pleas And Sentences

LITTLE VALLEY - Lori Pettit Rieman, Cattaraugus County district attorney, reported the following activity in Cattaraugus County Court on Monday, Aug. 20:

Daniel A. Andavaso, 30, presently incarcerated in the Cattaraugus County jail, was sentenced as a predicate felony offender to a term of two to four years in the state Department of Corrections for his conviction of third-degree burglary. Additionally, he was sentenced to a term of one to three years for violating the terms and conditions of a previously imposed probationary sentence.

Derrick R. Dyer, 30, of Buffalo, entered a plea of guilty to satisfy a pending indictment and was sentenced to pay a $100 fine for his conviction of attempted failure to register as a sex offender.

Daniel J. Kolata, 43, of Olean, was arraigned and entered a plea of innocent to an indictment charging him with DWI and failure to signal. The case has been adjourned for motions.

Matthew D. Cox, 39, of Pittsburgh, Pa., was arraigned and entered a plea of innocent to an indictment charging him with one count of third-degree grand larceny and one count of third-degree welfare fraud. The case has been adjourned for motions.

Donna J. Cox, 41, of Pittsburgh, Pa., was arraigned and entered a plea of innocent to an indictment charging her with one count of third-degree grand larceny, one count of third-degree welfare fraud and two counts of first-degree offering a false instrument for filing. The case has been adjourned for motions.

Dwight E. Johnston Jr., 44, of Dayton, was arraigned and entered a plea of innocent to an indictment that charges him with one counts of first-degree course of sexual conduct against a child, one count of first-degree rape, one counts of a second-degree criminal sexual act and one count of endangering the welfare of a child. The case has been adjourned for motions.

Jaycee M. Moore, 40, of Jamestown, entered a plea of guilty to third-degree attempted burglary and fourth-degree criminal mischief to satisfy a pending indictment. Sentencing is scheduled for Dec. 10.

Mackenzie L. Smith, 26, of Hinsdale, presently incarcerated in the Cattaraugus County Jail, waived prosecution by indictment and entered a plea of guilty by Superior Court information to one count of second-degree forgery, one count of petit larceny and one count of criminal obstruction of breathing or blood circulation. Sentencing is scheduled for Nov. 5.

Frank J. Reilly Sr., 73, of Olean, was arraigned and entered a plea of innocent to an indictment charging him with DWI and moving from a lane unsafely. The case has been adjourned for motions.

David J. Knoxsah, 23, of Olean, entered a plea of guilty to an indictment charging him with one count of petit larceny. Sentencing is scheduled for Dec. 10.

Ryan D. Radar, 41, presently incarcerated in the Cattaraugus County Jail, waived prosecution by indictment and entered a plea of guilty by Superior Court information charging him with three counts of third-degree burglary. Sentencing is scheduled for Nov. 5.
