Borrello: Voting issue is ‘Clerical Error’

By NICHOLAS L. DEAN OBSERVER Mayville Bureau
POSTED: October 30, 2009
County Legislature candidate George Borrello was for a time registered to vote in both Erie County and Chautauqua County. According to Democratic Election Inspector Norman P. Green, Borrello voted alternately between two addresses — violating New York state election law. Borrello on Tuesday called the situation a ‘‘clerical error’’ on the part of the Erie County Board of Elections and maintained that though he was simultaneously registered ‘‘for a few years,’’ his voting record has been in Chautauqua County. ‘‘When I re-registered out here, when we decided to make this our full-time residence, Erie County never removed me from the voting rolls,’’ Borrello said. ‘‘And actually, the Chautauqua County Board of Elections sent three letters on three separate occasions asking to remove me from the list, but the Erie County Board of Elections never removed me from the list.’’ According to Green, Borrello has maintained an uninterrupted voter registration from his Irving home since 1985 and from his Williamsville home since 1996. In a letter to Republican Election Commissioner Brian Abram, Green listed Borrello as having voted in Erie County in 1996, in Chautauqua County in 1997 through 2001, then again Erie County in 2001 and in Chautauqua County since 2004. According to Green, Borrello continued to receive mail from the boards of election at both residences. Responding, Borrello said it’s not true and looks forward to telling the voters of Chautauqua County, particularly those in his district, what he would like to do for them. ‘‘If there was nothing political involved here,’’ Borrello said of the situation and the coming election, ‘‘why wouldn’t you just do the logical thing and call Erie County and have them remove me from the rolls.’’ According to Green, the New York state Board of Elections recently directed that Borrello’s voter registration in Chautauqua County be canceled. Borrello has since re-registered to vote in Chautauqua County and the Board of Elections has accepted his new registration application. Additionally, after ‘‘much personal deliberation,’’ Green said he has decided not to have the matter investigated by law enforcement or to refer the matter to the district attorney’s office as he is ‘‘empowered to do’’ by New York state election law. George Borrello is a candidate for County Legislature District 4 and is endorsed by the Republican, Independence and Conservative parties.
